Terms and Conditions

1. Service Agreement

By engaging the services of Personalpresent, you agree to these terms and conditions. All photography services are provided subject to these terms unless otherwise agreed in writing. These terms constitute a legally binding agreement between you and Personalpresent. If you do not agree with any part of these terms, you must not use our services.

Personalpresent reserves the right to refuse service to anyone at any time for any reason. We maintain the right to modify these terms at any time, and such modifications will be effective immediately upon posting on our website.

2. Booking and Payment

A deposit is required to secure your booking. The deposit amount varies by service package: Basic packages require a 50% deposit, Pro packages require a 40% deposit, and Premium packages require a 30% deposit. The remaining balance is due before or on the day of the photography session. Payment methods accepted include bank transfer, credit card, and cash.

Cancellations made more than 48 hours in advance are eligible for a full refund of the deposit. Cancellations within 48 hours may be subject to a cancellation fee equal to 50% of the total service cost. Cancellations made less than 24 hours before the scheduled session may result in forfeiture of the entire deposit. Rescheduling requests made more than 48 hours in advance are accommodated at no additional charge, subject to availability.

All prices are quoted in Australian Dollars (AUD) and are subject to change without notice. Once a booking is confirmed and deposit paid, the quoted price is locked in for that specific booking.

3. Image Licensing and Usage Rights

Upon full payment, you receive a personal use license for all delivered images. This license permits you to print, share on social media, and use images for personal or business purposes such as websites and marketing materials. The license is non-exclusive, meaning Personalpresent retains the right to use images for promotional purposes.

Commercial usage rights, including advertising campaigns, stock photography, or resale of images, require separate licensing agreements and additional fees. Commercial licensing fees are determined based on the intended use, distribution scope, and duration of use. Personalpresent retains copyright to all images unless explicitly transferred in writing through a separate copyright transfer agreement.

You may not edit, alter, or manipulate images in ways that misrepresent the original work or damage the reputation of Personalpresent without prior written consent. Watermarked images are for preview purposes only and may not be used publicly.

4. Image Delivery

Images are delivered via secure online gallery within the timeframe specified for your service package. Standard delivery times are: passport photos same day or within 24 hours, portrait sessions 1-2 weeks, event coverage 2-3 weeks. Rush delivery may be available for an additional fee of $150 for 48-hour turnaround, subject to availability.

You are responsible for downloading and backing up your images. Online galleries are maintained for 90 days after delivery. After this period, images may be archived and retrieval may incur additional fees. We recommend downloading all images immediately upon receipt and maintaining your own backups.

Delivery formats include high-resolution JPEG files suitable for printing and web-optimized versions for digital use. RAW files are not included in standard packages but may be available upon request for an additional fee.

5. Retouching and Editing

All packages include standard editing: color correction, exposure adjustment, white balance correction, and basic blemish removal. Advanced retouching services are available as add-ons at $25 per image. We maintain a natural, authentic aesthetic while enhancing image quality.

Extensive manipulation or stylistic changes beyond standard editing require additional fees and must be discussed prior to post-production. This includes but is not limited to: extensive skin smoothing, body contouring, background replacement, composite work, and artistic color grading beyond standard correction.

Clients may request specific editing preferences during the consultation phase. While we accommodate reasonable requests, we reserve the right to decline edits that compromise the artistic integrity of the work or misrepresent the subject matter.

6. Cancellation and Rescheduling

Clients may reschedule sessions with at least 48 hours notice, subject to availability. Rescheduling within 48 hours may incur a rescheduling fee of $50. Rescheduling requests made less than 24 hours before the session may be treated as a cancellation.

Personalpresent reserves the right to cancel or reschedule sessions due to illness, equipment failure, severe weather, or unforeseen circumstances beyond our control. In such cases, clients will be offered a full refund or rescheduling at no additional cost. We will provide as much advance notice as possible in these situations.

If a client fails to appear for a scheduled session without prior notice, the session fee is forfeited. Late arrivals may result in reduced session time without refund, depending on the circumstances and availability.

7. Client Responsibilities

Clients are responsible for obtaining necessary permits for location photography, ensuring access to venues, and coordinating with other parties involved. For event photography, clients must provide a timeline and list of key moments to capture at least one week before the event.

Clients should inform the photographer of any specific requirements, restrictions, or preferences prior to the session. This includes accessibility needs, cultural considerations, and any subjects who do not wish to be photographed. Clients are responsible for obtaining model releases from all subjects when required.

For location shoots, clients must ensure the location is accessible, safe, and legally permissible for photography. Any fees associated with location access are the responsibility of the client unless otherwise agreed.

8. Limitation of Liability

Personalpresent is not liable for failure to deliver services due to circumstances beyond reasonable control, including but not limited to natural disasters, equipment failure, client-provided venue restrictions, or acts of third parties. Liability is limited to the total value of the service package purchased.

Personalpresent is not responsible for loss or damage to client property during sessions. Clients are advised to secure valuable items and personal belongings. We maintain professional liability insurance, but clients are encouraged to obtain their own insurance for valuable items or events.

In no event shall Personalpresent be liable for indirect, incidental, special, or consequential damages arising from the use of our services or images, even if advised of the possibility of such damages.

9. Model Release

By participating in a photography session, clients grant Personalpresent permission to use images for portfolio, marketing, and promotional purposes unless otherwise agreed in writing. This includes use on our website, social media, print materials, and submission to photography competitions or publications.

Clients may request that specific images not be used for promotional purposes, and such requests will be honored when made in writing. However, we reserve the right to use images in our portfolio and for marketing purposes unless a specific exclusion is agreed upon at the time of booking.

For events with multiple subjects, clients are responsible for informing all participants about potential promotional use of images. Personalpresent will honor requests to exclude specific individuals from promotional use when requested.

10. Dispute Resolution

Any disputes arising from these terms or services provided will be resolved through good faith negotiation. If resolution cannot be reached through direct communication, disputes will be subject to mediation before pursuing legal action.

If mediation is unsuccessful, disputes will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia. These terms are governed by Australian law.

Clients agree to attempt resolution through our customer service channels before initiating any formal dispute resolution process. We are committed to resolving issues fairly and promptly.

11. Intellectual Property

All photographs, images, and creative works produced by Personalpresent are protected by copyright law. Unauthorized reproduction, distribution, or use of images without proper licensing is prohibited and may result in legal action.

Personalpresent retains all rights to the creative process, artistic interpretation, and final images unless explicitly transferred through a written agreement. Clients receive usage rights as specified in their service agreement, not ownership of the images themselves.

12. Changes to Terms

Personalpresent reserves the right to modify these terms at any time. Clients will be notified of significant changes via email or through our website. Continued use of services after changes constitutes acceptance of modified terms.

Changes to terms do not affect existing bookings made under previous terms, unless the changes are required by law or address safety concerns. In such cases, we will work with clients to find mutually acceptable solutions.
